1. Agreement to Terms

Welcome to Lake Stay, operated by Alghahim Africa. These Terms and Conditions ("Terms") govern your use of our platform, website, and services. By accessing or using Lake Stay, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

We reserve the right to modify these Terms at any time. We will notify you of material changes, and your continued use of the platform constitutes acceptance of the updated Terms.

2. Definitions

• "Platform" refers to the Lake Stay website, mobile applications, and related services
• "User" refers to anyone who accesses or uses the Platform
• "Guest" refers to Users who book properties through the Platform
• "Partner" or "Host" refers to property owners who list their properties on the Platform
• "Booking" refers to a reservation made through the Platform
• "Property" refers to lakeside accommodations listed on the Platform

3. Eligibility and Account Registration

3.1 Eligibility

You must be at least 18 years old to use Lake Stay. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3.2 Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, illegal, or harmful activities.

4. User Responsibilities

4.1 Prohibited Activities

You agree not to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Submit false or misleading information
• Engage in fraudulent bookings or payments
• Harass, threaten, or abuse other Users
• Attempt to circumvent security features
• Use automated tools to access the Platform without permission
• Post malicious code or viruses
• Impersonate others or misrepresent affiliations

4.2 Content Standards

All content you submit must be accurate, lawful, and respectful. We reserve the right to remove any content that violates these standards.

5. Booking and Payment Terms

5.1 Booking Process

When you make a booking, you enter into a contract with the property Host. Lake Stay acts as a platform to facilitate this transaction. You agree to honor your booking commitments and comply with the Host's property rules.

5.2 Payments

• All payments are processed securely through PayPal
• Prices are displayed in the applicable currency and include applicable taxes unless stated otherwise
• Full payment is required at the time of booking
• Lake Stay charges a service fee for facilitating bookings
• You authorize us to charge your payment method for all amounts due

5.3 Cancellation and Refunds

Cancellation policies vary by property and are set by Hosts. Review the specific cancellation policy before booking. Refunds are processed according to the applicable cancellation policy. Lake Stay service fees are generally non-refundable.

6. Partner Terms

6.1 Partner Application

To list properties, you must apply to become a Partner. We conduct KYC (Know Your Customer) and KYB (Know Your Business) verification. Approval is at our discretion and may be revoked if you violate these Terms.

6.2 Listing Requirements

Partners must:

• Provide accurate property descriptions and photographs
• Set fair and competitive pricing
• Maintain property standards and safety requirements
• Honor confirmed bookings or face penalties
• Respond promptly to Guest inquiries
• Comply with all local laws and regulations

6.3 Partner Fees

Lake Stay charges Partners a commission on each booking. Commission rates are communicated during the Partner onboarding process. Payments to Partners are processed within 3-5 business days after Guest check-in.

6.4 Partner Liability

Partners are solely responsible for their properties, including safety, maintenance, and compliance with local laws. Partners must have appropriate insurance coverage.

7. Intellectual Property Rights

All content on the Platform, including text, graphics, logos, images, and software, is the property of Lake Stay or its licensors and is protected by copyright, trademark, and other intellectual property laws.

By submitting content (reviews, photos, etc.), you grant Lake Stay a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with the Platform.

8. Disclaimers and Limitations of Liability

8.1 Platform Provided "As Is"

The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Platform's operation, availability, or accuracy of information.

8.2 Third-Party Interactions

Lake Stay is not a party to agreements between Guests and Hosts. We are not responsible for the actions, quality of service, or conduct of Users. Disputes should be resolved directly between the parties involved.

8.3 Limitation of Liability

To the maximum extent permitted by law, Lake Stay and Alghahim Africa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Platform.

9. Indemnification

You agree to indemnify, defend, and hold harmless Lake Stay, Alghahim Africa, and their affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of third-party rights.

10. Dispute Resolution

10.1 Informal Resolution

If you have a dispute, please contact us first to seek informal resolution at support@lakestay.com.

10.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the laws of the jurisdiction where Alghahim Africa is registered.

10.3 Governing Law

These Terms are governed by the laws of the jurisdiction where Alghahim Africa operates, without regard to conflict of law principles.

11. Force Majeure

Lake Stay is not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, or government actions.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lake Stay regarding use of the Platform.
